AIPLA's Patent Law Committee maintains a collection of sample documents related to day-to-day patent prosecution.  These documents are exemplary and may not be ideal for every situation. Use them at your own risk.*

Model Response Shells:

Each of these documents contains a comprehensive shell document that can be used to formulate a response to 35 U.S.C. 112, 102, 103, or 101 rejections made by a patent examiner during prosecution.

Model Appeal Brief: (Doc)  (PDF)

This document contains the overall structure of appeal brief with a section for drafting responses to point out error in rejections made in 35 U.S.C. 112, 102, 103, 101, and obviousness-type double patenting rejections.  The model appeal brief includes summaries of the relevant portions of the PTAB’s designated informative and precedential decisions applicable to ex parte appeals along with associated Federal Circuit case law.

This document contains the overall structure of a reply brief along with relevant case law summaries to use for handling new grounds of rejection in an Examiner’s Answer.

The AIPLA IP Transactions Committee is hosting an IP Transactions Bootcamp immediately following the AUTM Conference in Seattle, WA.  The AUTM conference is a comprehensive program for University Technology Managers.  For more information on the AUTM conference, visit their Conference website. 

What to Expect

This in-person-only bootcamp is designed to provide practical insights and strategies for professionals working in intellectual property transactions. The day features a comprehensive agenda including:

  • Panels and CLE Sessions: Learn about Working with Tech Transfer Offices, Strategies for successful collaborations between nonprofits and industry, and Protecting and monetizing an AI asset.
  • Drafting and Negotiating Tips: Get practical advice on drafting and negotiating strategic collaboration and license agreements.
  • Hands-on Workshop: Participate in a Mock licensing negotiation to put your skills to the test.
  • Networking: Conclude the day with a dedicated Networking reception.

The cost to attend is $145 per person for AIPLA and AUTM members, which includes breakfast/coffee breaks and the networking reception (lunch is not provided).  Non-member (either AIPLA or AUTM) - $595
