The US Court of Appeals for the Federal Circuit on November 15, 2019, ruled that a district court erred when it found KPN N.V.'s data transmission systems patent unpatentable as an abstract idea. Koninklijke KPN N.V. v. Gemalto M2M GmbH, Fed. Cir., No. 18-01863, 11/15/19. The patent was directed to an improved check data generating device. The Federal Circuit found that the device “enables a data transmission error detection system to detect a specific type of error that prior art systems could not,” and thus represents a “non-abstract improvement in the functionality of an existing technological process[.]”
