On June 21, 2021, in a 5-4 decision, the U.S. Supreme Court issued its decision in United States v. Arthrex, Inc., Nos. 19-1434, 19-1452, and 19-1458, reversing and vacating the Federal Circuit decision. Chief Justice Roberts issued the majority decision, holding that the unreviewable authority wielded by Administrative Patent Judges (APJs) during inter partes review is constitutionally incompatible with their appointment by the Secretary of Commerce to an inferior office.  The majority found that “35 U. S. C. § 6(c) is unenforceable as applied to the Director insofar as it prevents the Director from reviewing the decisions of the PTAB on his own.”  In this case, the Court determined that an appropriate remedy is a remand to the Acting Director to decide whether to rehear the petition filed by Smith & Nephew. Additionally, the Court stated that Arthrex is not entitled to a hearing before a new panel of APJs.  The Court’s full decision may be found here.
