Mediation of patent, trade secret, trademark/trade dress, copyright disputes. From 2005 until appointed to the San Diego Superior Court in 2015, Judge Scherling’s practice focused on litigation of patent, trademark and trade secret matters involving domestic and international companies, large and small, in cases throughout the country. It entailed the full range of representation and client counseling, including: preparation of complaints and counterclaims; preliminary injunctions; all aspects of fact and expert discovery; mediation and settlement; dispositive motions; trials; post-trial motions; and appeals. Shortly before his appointment to the Court, Judge Scherling was selected as a mediator by the World Intellectual Property Organization. He now mediates cases with JAMS.
