[IP Practice in Europe Committee] Specialty Patent Courts in Europe and Comparison with US Proceedings

On both the national and the European level there is a trend towards increasing specialization of patent jurisdictions. The EPO (Opposition Division, Boards of Appeal) and specialized Courts in most of the national Jurisdiction have gathered experience over decades. But there are also important changes on the national (German Federal Patents Court, IPEC in the UK) and European wide (UPC) level that implement new frameworks for deciding patent cases. The panel addresses the major factors that govern litigation in specialized European Courts as well as in the US: (1) European Patent Office; (2) United States; (3) United Kingdom; and (4) Germany.
