Benjamin Fink is a shareholder at Berman Fink Van Horn P.C. in Atlanta, Georgia. With more than 30 years of experience, Benjamin has built a national litigation practice representing both defendants and plaintiffs in complex, high-stakes litigation involving noncompete, trade secret, and competition-related disputes. Benjamin regularly appears in U.S. state and federal courts and arbitrations nationwide, where he has successfully tried cases, defended and obtained injunctions, prevailed on numerous motions, and obtained favorable settlements.

A prolific thought leader in the field, Benjamin regularly provides commentary on the latest issues related to his practice. He co-authored a chapter on restrictive covenant litigation in the 2026 edition of Georgia Business Litigation published by ALM and co-authored a Practice Note on Georgia Confidentiality, Nondisclosure, and Non-Solicitation Agreements for Thomson Reuters’ Practical Law. He regularly blogs on noncompete and trade secret topics, as well. In recognition of his thought leadership in the trade secrets arena, he was invited to attend The Inaugural Sedona Conference on Developing Best Practices for Trade Secrets Issues. Benjamin previously served as a Contributing Editor to The Sedona Conference Commentary on Protecting Trade Secrets in Litigation About Them. He now serves on the Steering Committee for the Sedona Conference Working Group 12 on trade secrets.

Benjamin regularly lectures on noncompete, trade secret, and other related topics throughout the country. He has presented at the Practicing Law Institute’s annual Noncompetes and Restrictive Covenants and Advanced Trade Secrets seminars and moderated a trade secrets presentation at the 2025 Sedona Conference Working Group 12 Annual Meeting. He recently co-chaired the State Bar of Georgia ICLE’s annual Restrictive Covenants and Trade Secrets seminar.

Benjamin previously served as Chair of the Trade Secrets Committee of the American Intellectual Property Law Association and Chair of the Labor and Employment Law Section of the Atlanta Bar Association. He currently serves as Co-Chair of the Atlanta Bar Judicial Selection & Tenure Committee.
