AIPLA Comments to the EU on Proposed Standards Essential Patent (SEP) Regulation

Arlington, VA. August 10, 2023 - The American Intellectual Property Law Association (AIPLA) submitted comments to the European Commission on their new Standards Essential Patent (SEP) regulation proposal.
The comments reflect AIPLA’s support for innovation in Standards Essential Patent (SEP) licensing solutions and express concerns about the impact of the proposed regulation to the effective and efficient licensing of SEPs. Specific concerns expressed in our comments include harmonization of the proposed regulation with international and European laws, whether the stated justifications for the regulation are consistent with the scope of the proposed regulation, and whether particular aspects of the regulation would be supportive of the international system of standards development and SEP licensing progress.
