AIPLA Comments on USTPO Patent Fee Setting and Adjusting Proposal to the Patent Public Advisory Committee

Arlington, VA. May 31, 2023 - The American Intellectual Property Law Association (AIPLA) submitted comments on the United States Patent and Trademark Office’s recent Patent Fee Setting and Adjusting Proposal (“Fee Proposal”) to the Patent Public Advisory Committee (PPAC).

AIPLA has previously expressed the view that fees, in the aggregate, should recover 100% of the costs of the Office, and that the relationship between “front-end” and “back-end” fees should be maintained, and encourages this approach to continue.

AIPLA recognizes the need for the Office to increase patent fees given the current economic environment and the time elapsed since the last fee increase. However, the comments question whether all the proposed fees are justified. The comments request that the Office provide additional information regarding the costs associated with the procedures and programs that are targeted for significant fee increases or new fees.
