Course Description:
Please join AIPLA for an informative online CLE discussing recent and developing legislation and its impact on Section 337 investigations before the U.S. International Trade Commission (ITC) and enforcement of ITC exclusion orders.  Our lively and informative discussion first will be led by former ITC employee Kim E. Choate, now Special Counsel at Cadwalader, Wickersham & Taft, and then by U.S. Customs and Border Protection attorneys Dax Terrill and William Washington, on the following topics:

Will the ITC become a popular forum for copyright and trademark owners in 2012?  Who stands in what corner of the ring when it comes to SOPA, STOP, PIPA and OPEN, and why even technical clients, in-house counsel and patent owners should pay attention. 

The New AIA & Section 337:  Mapping a New Strategic Course for Patent Disputes
Does the new America Invents Act (AIA) impact litigating at the ITC?   How will the ITC handle post-issuance challenges with the implementation of these new rules?  And how will these new venues for challenging patents effect your ITC litigation strategy? 

Views from CBP:  The Post-Issuance Stage of ITC Exclusion Orders
In light of the increasing number and complexity of section 337 actions, how does U.S. Customs and Border Protection administer and enforce ITC exclusion orders?  What is the process within CBP immediately following the issuance of an exclusion order?  What aspects of CBP’s operational structure and legal framework should all 337 practitioners know?
