Section 101 is still a hot topic—the line between patentable and unpatentable subject matter continues to move as the gatekeepers of Section 101 shift the patent eligibility sands. This webinar will discuss the current state of Section 101, as well as map its history and dare to predict its future. The webinar will explore different aspects of patent eligibility as it applies to business method and biotech patents, including discussions of Prometheus and Myriad, and discuss pertinent internal guidelines currently followed by the United States Patent and Trademark Office. Course Description:
Under Section 337 of the U.S. trade laws, the U.S. International Trade Commission is increasingly a premier forum for intellectual property litigation in the United States. When can a complainant (plaintiff) use Section 337 and when are the district courts a better bet? Learn how litigating under Section 337 compares to litigating in the district courts, including the rocket dockets, when Section 337 might be a forum you should consider to enforce your IP rights, and what you will face if you are named as a respondent in a Section 337 investigation. Also learn what the current state of the law is with regard to satisfying the “domestic industry” requirement for instituting a Section 337 investigation.
