The United States Patent & Trademark Office (USPTO) and the American Intellectual Property Law Association (AIPLA) are hosting a roundtable discussion on China’s system for procuring and enforcing utility model and design patents.  The roundtable will provide U.S. companies, inventors, attorneys, and other interested members of the public with the opportunity to obtain and share information about China’s utility model and design patent system.  Participants will hear from two panels of experienced and knowledgeable IP professionals from the United States and China on the procurement and enforcement of such patents in China, and will have the opportunity to ask questions and share experiences, views and opinions with the panelists.  We are especially interested in understanding how China’s system for procuring and enforcing utility model and design patents is working for rights holders, whether any improvements are needed, and what steps might be taken to improve the system.

Introduce recent changes to the patent law, implementing regulations, examination guidelines, and other updates with a focus on the procurement and enforcement of utility model/design patents.

Panelists will discuss their views and experience with procuring utility model/design patents in China, including filing strategies, problems with the system, and possible solutions to those problems.  Q&A to follow.

Panelists will discuss their views and experience with enforcing utility model/design patents in China, including through administrative actions, court actions, and customs.  Panelists will also discuss their views and experience with invalidation proceedings at the Patent Review and Adjudication Board of SIPO.  Problems with the systems and possible solutions will be examined.  Q&A to follow.
