Trademarks are a form of intellectual property directed to a distinctive source indicator (e.g., word, phrase or design) used by an entity such that specific products or services associated with the entity using the source indicator are distinguished from the products or services of other entities. An unregistered trademark or service mark is a mark that has not been registered with a government, but has acquired certain legal rights through usage. A registered trademark is a mark that has been registered with a government and generally includes additional legal rights beneficial to the trademark owner.
A trademark is designated with products and services with the following symbols:
™ TM (for a common law or unregistered mark used to promote or brand goods)
SM SM (for a common law or unregistered service mark, that is, a mark used to promote or brand services)
® (for a registered trademark used t to promote or brand either goods or services)
