Broadest Reasonable Interpretation Subcommittee

This subcommittee has looked at about 400 PTAB decisions and formed some preliminary impressions with respect to the present state Broadest Reasonable Interpretation (BRI). Further, the subcommittee has addressed a couple of legal issues in the following short, working drafts: BRI vs Phillips and use of the specification to inform interpretation; and short of definition by implication. Upcoming tasks include outlining a revision of M.P.E.P. 2111.01, determining what in particular we are looking for in the corpus of 370 0 PTAB cases that mention BRI, and identifying Federal Circuit opinion research to further undertake.  This subcommittee presented on BRI during the 2016 Annual Meeting.
