IP Practice in China

Sec. 1. Under the guidance of the President and the Executive Director, this committee shall:

(a) Establish and maintain relations with professional societies in China whose members are interested in intellectual property law.
(b) Study the law and practice of China and report on issues of interest to the association Board of Directors and membership.
(c) Provide information on U.S. intellectual property law to any interested party in China, if called upon to do so.

Sec. 2. This committee shall coordinate its activities with the International and Foreign Law Committee.

The Chinese Supreme Court recently ruled that it is not infringement to put a trademark on manufactured products for export only on the basis that there would not be any confusion to the relevant public regarding the source of the products.  The party ordering the products from the Chinese manufacturer owned the identical mark in Mexico and several other countries where the goods were being exported, while the mark was owned/registered to a different party in China.  The report presents for discussion four competing views on how the law should be interpreted.


We have posted an English version of the draft guidelines for administrative enforcement of patents (by SIPO) which were posted for public comment.  Unfortunately, we received these too late to be able to comment as a committee (due Nov. 9th), but I hope that we, as a committee, can review and vet these provisions so we can develop a position for future advocacy as well as be better prepped for serving our clients as things develop in this area of IP practice in China.  Please see the draft in "Useful Links and Documents-China IP / Chinese IP Law & Regulation" limk to the left and be ready to discuss at the up coming committee teleconference.

It draws note to the SIPO oatent quality papers published last December and starts the discussion on Chinese patent policy trends and the potential impact on Chinese industry and patent system.

​​​The State Council of China & SIPO have announced that Shen Changyu has replaced Tian Lipu as SIPO's commissioner.  Dr. Shen's background includes President of Dalian University of Technology, member of Chinese Academy of Sciences, and numerous publications, books and has worked on National level research projects.
