AIPLA STATEMENT ON HOUSE PASSAGE OF HISTORIC PATENT REFORM BILL

ARLINGTON, VA—AIPLA appreciates the extraordinary effort of Judiciary Committee Chairman Lamar Smith and other members of the House in shepherding historic patent reform legislation to its next crucial step toward final enactment.

Like the Senate-passed bill, this legislation takes monumental steps in modernizing the current law in both substance and process.  Among other things, the legislation adopts a first-inventor-to-file system, a cost-saving post-grant review system, and a process intended to reduce the risks of patent fee diversion.


AIPLA President David Hill said “It is hard to fathom the true enormity of this passage.  Like any legislation, the outcome here was not our ideal, particularly with respect to PTO funding, but on balance the improvements to the law will vastly improve the patent system.”  Executive Director Q. Todd Dickinson said “This was a significant accomplishment that overcame substantial obstacles, but now our attention will quickly turn to the Senate in an effort to find common ground that will clear the path to the President’s desk.”
