AIPLA Applauds Introduction of PATENT Jobs Act


WASHINGTON, DC - The American Intellectual Property Law Association (AIPLA) commends Reps. Mike Honda (D-Calif.), Zoe Lofgren (D-Calif.) and Anna G. Eshoo (D-Calif.) for introducing the Patents and Trademarks Encourage New Technology Jobs Act, or PATENT Jobs Act, a bill that would end the sequestration of almost $150 million of US Patent and Trademark Office (USPTO) funds for Fiscal Year (FY) 2013. The bill would also create a specific exemption from sequestration for the USPTO from FY 2014-2021.
"We applaud Rep. Honda for offering legislation that can remove the dark cloud that sequestration casts on USPTO funding.  After years of effort, Congress recently renewed the patent system with the Leahy-Smith America Invents Act, and its implementation is severely threatened by proposed cuts.  We believe that Rep. Honda's bill recognizes the unique fee-funded status of the USPTO and provides the best chance of ensuring the necessary funding for effective implementation of the AIA," said AIPLA Executive Director Q. Todd Dickinson.

An interpretation of the Balanced Budget and Emergency Deficit Control Act of 1985 by the Office of Management and Budget projected severe cuts to USPTO funding.  The threat of a funding shortfall comes at a critical time for the USPTO, which is not only trying to reduce a backlog of thousands of applications but is also in the process of developing many new procedures required by the AIA.  The legislation follows a bipartisan letter sent earlier this week by members of the California delegation to the Commerce, Justice, and Science Appropriations Subcommittee asking for a remedy.
