 What's New at AIPLA

 

Important Changes at the USPTO as a result of The America Invents Act

President Obama on September 16, 2011, signed legislation (H.R. 1249) to make the most extensive changes in the patent law in nearly 60 years.  Many of the dramatic changes in the law do not go into effect right away:

•Changed standard for declaring reexaminations
•Human organism patents prohibited;
•Filing deadline for patent term extension applications clarified;
•Virtual and false marking provisions changed;
•Venue for certain suits over USPTO decisions is changed from DDC to EDVA;
•Changed statute of Limitations for disciplining practitioner misconduct; and
•Establishment of micro-entity fee discount.
