This teleconference will feature a roundtable discussion among practitioners with some involvement in the KSR case to examine the realized and unrealized expectations in the wake of the Supreme Court decision. The participants will consider the meaning of the decision as it is applied by PTO examiners to patent applications and by the courts in infringement suits.
 
Among other things, the panelist will discuss the following questions:
 
1.  Is the decision a course correction or a revolution in patent validity determinations?
 
2.  Will patent examiners be encouraged to find obviousness more freely?
 
3.  Does the decision take adequate account of the hindsight problem?
 
4.  Does the analysis of recent Federal Circuit opinions conform to the KSR test?
 
5.  Can the decision be expected to eliminate more bad patents than before?
