4. Antitrust: Current Trends in Product Tying and Standard Setting Boards

This seminar examined how the federal enforcement agencies and the courts have dealt with “patent ambush” and the related issue of “patent holdup”. It included a discussion of the Federal Trade Commission’s recent Rambus decision, which found deceptive conduct in the absence of an express disclosure requirement, and the Justice Department’s October 30, 2006 Business Review Letter, which addressed a SSO’s requirement that participants in the standard setting process specify ex ante maximum royalty rates for their essential patents.

7. Alignment of IP Strategies

8. The new GNU General Public License - A Direct Attack on Software Patents and Patent Licensing?

10. Global Infringement Liability after the Supreme Court Decision in Microsoft v. AT&T
Wednesday, Sept. 12, 2007: 12:30 - 2:00 pm EST
In Microsoft v. AT&T, the Supreme Court decided that under 35 U.S.C. Sec. 271(f) a "component" that can give rise to liability for infringement of a patent claim covering a physical product must itself be a tangible item that was supplied from the United States and physically combined abroad to form the accused product. This discussion brought the views from Microsoft's in-house counsel as to how the case was managed for appellate review, and focus on the Supreme Court decision and its implications for both the computer industry and for other industries. The discussion also addressed those questions left unanswered by the Supreme Court concerning both product and process claim liability under Sec. 271(f).

11. Prosecution Strategies on Appeal- Appeal Briefs and Oral Hearings
